This person cannot have a classification as a predator, violent person or a predicate sex offender. Relief from the RegistryIt is usually only someone that is a level two or lower that has not received a designation attached to the risk level that can petition for relief from the registry. The factors connected with these classifications come from the case and charges assigned to this individual. Any designation or classification on top of the level can also require a life registration because of the crimes the person committed against others. Based on the state, the first level can require up to twenty years and the second and third may require a life registration. This classification also governs the time of registration necessary. These include sexual predator, sexual violent violator and a predicate sexual offender. Other factors can include the interim between registration and the risk level hearing as well as any pending action or confirmation of registration of theĭesignation with the Risk LevelOther designations can assign a sex offender with a greater risk level than the simple one through three with the classification. These risks also affect the duration of registration in the state. These risks exist based on the amount and types of information available about the individual. The third is the highest risk and a possible threat to public safety in the community. The second is a moderate risk with a greater chance of a repeat in sexual violations. The first is a low risk or possible repeat offenses. The Three Primary Risk LevelsThe sex offender is in one of three primary risk levels which include levels one through three. However, even someone convicted of the same offense as another could receive a different level as that person. Multiple convictions for similar or the same crime could increase the level of risk and the level of danger this person could cause a community. The risk level will reflect the sex offender’s case factors and how likely he or she will harm someone in the community when not in jail. This danger is a possible detriment to a community and to society in general. Risk Level and ClassificationThe risk level is something the court will assess based on the likelihood of the offender committing the crime again in the future. However, one penalty for some of these convictions is registration. Often, the state will have certain legal violations that lead to charges and can end in a conviction because of sufficient evidence against the defendant. Many of these crimes are more serious such as sexual assault, molestation of a minor or computer sex crimes. This is a mandatory requirement based on the crime this person receives a conviction of at the time. Registration with the StateWhen someone commits a sex offense or certain violations in the state, he or she will need to register with the sex offenders’ registration. This could increase or decrease the need to keep the offender away from certain groups and school locations in a town. There are different levels of risk and designation applied to sex offenders according to various states that will attach a risk level and classification to the individual on the sex offenders’ registry in the state.
